
Terms and Conditions of the please touch Online Store
I. General Provisions

These Terms and Conditions define the rules for using the Store, including the conditions for placing orders, delivery of goods, payments, withdrawal from the contract and complaint procedures.

By using the Store, the Client agrees to comply with these Terms and Conditions and applicable law.
II. Definitions

Seller - please touch studio Mateusz Dobrowolski, conducting business activities as specified in Section I.

Client - a natural person, legal person or organisational unit that uses the Store and purchases goods.

Consumer - a natural person making a purchase not directly related to their business or professional activity.

Entrepreneur acting as a Consumer - a natural person running a sole proprietorship who enters into a contract with the Seller not directly related to their professional activity.

Goods - products offered in the Store, including furniture and accessories.

Sales Agreement - a distance contract concluded between the Seller and the Client for the sale of Goods.
III. Rules for Placing Orders

Purchases in the Store may be made either as a guest or by registering an account.

The Client places an order by adding products to the cart and completing the order form.

After placing an order, the Client receives an email confirming that the order has been accepted for processing.

The Sales Agreement is concluded at the moment the Client receives confirmation of order acceptance.
IV. Payments and Delivery

The following payment methods are available in the Store:

Delivery is carried out within Poland and the European Union. Delivery costs are provided on the Store's website.

The delivery time depends on product availability and the selected delivery method.

The Seller is not responsible for delays caused by courier companies.
V. Right of Withdrawal
Right of Withdrawal

A Client who is a Consumer or an Entrepreneur acting as a Consumer has the right to withdraw from the contract without giving any reason within 14 days. To meet this deadline, it is sufficient to send a withdrawal statement before its expiry.

Withdrawal Period

For Goods - the 14-day period begins on the day the Goods are delivered to the Client or a third party indicated by the Client.

For service contracts - the period begins on the day the contract is concluded.

Confirmation
-
Upon receiving the withdrawal statement, the Seller will send the Client a confirmation to the email address provided in the order.
Exceptions
-
The Client is not entitled to withdraw from the contract in cases specified in Article 38 of the Consumer Rights Act, in particular when:
a) The service has been fully performed with the Client's express consent, who was informed that after performance they lose the right to withdraw.
b) The price depends on fluctuations in the financial market beyond the Seller's control.
c) The Goods are non-prefabricated, made to the Client's specifications or clearly personalised.
d) The Goods are perishable or have a short shelf-life.
e) The Goods are delivered sealed and cannot be returned after opening for health or hygiene reasons.
f) The Goods become inseparably mixed with other items after delivery.
g) The Goods are sealed audio/video recordings or software unsealed after delivery.
h) The contract was concluded at a public auction.
i) The subject of the contract is digital content not supplied on a tangible medium, if performance began with the Client's express consent before the withdrawal deadline.
Refunds

In the event of valid withdrawal, the contract is deemed not concluded, and both parties must return what they received.

The Seller will refund all payments, including delivery costs (except extra costs for more expensive delivery methods), within 14 days of receiving the withdrawal statement.

The Seller may withhold the refund until receiving the Goods back or receiving proof of return - whichever occurs first.

Refunds are made using the same payment method used by the Client unless the Client agrees to another method at no additional cost.

Return of Goods

The Client must return the Goods in an unchanged condition unless modification was necessary to determine their nature, characteristics and functionality.

Goods should be returned without delay, no later than 14 days from the withdrawal date.

The Client bears the direct cost of returning the Goods unless the Seller agrees to cover it.

The Seller may withhold the refund until the Goods are received or proof of postage is provided.

VI. Complaints and Warranty
Legal Basis

The Client has the right to file a complaint if the purchased Goods are defective or non-compliant with the contract, based on the Civil Code and the Consumer Rights Act.
Who May File a Complaint
-
a) A Consumer or Entrepreneur acting as a Consumer.
b) Entrepreneurs who are not Consumers - complaints are handled based on warranty regulations and the terms of the Sales Agreement.
How to File a Complaint

Complaints must be submitted electronically to hello@pleasetouch.studio and should include:

Client's name

Order number

Description of the defect or non-compliance

Photos (if possible)

Preferred resolution (repair, replacement, refund)

Complaint Processing Time

The Seller will review the complaint within 14 business days. Lack of response within this time means the complaint is accepted.
Resolution Options

If the complaint is accepted, the Seller will offer:

repair of the Goods
-
replacement with a new item
-
refund if repair or replacement is impossible or unsatisfactory

Warranty (Rękojmia)

Consumers have a 2-year warranty period starting from the date the Goods are delivered.

Entrepreneurs acting as Consumers also have a 2-year warranty, provided the Goods qualify for Consumer rights.

The warranty covers physical defects existing at purchase or discovered within the warranty period.

A valid complaint entitles the Client to repair, replacement or refund.

Costs of Returning Defective Goods

If the complaint is accepted, the Seller covers the return and repair or replacement costs.

If the complaint is not accepted, the Client covers the cost of returning the Goods.

Withdrawal from Contract Due to Defects

Filing a complaint does not limit the Client's right to withdraw from the contract if the Goods are defective or non-compliant.
Additional Information

If the Seller does not accept the complaint, the Client may pursue claims in court or through alternative dispute resolution methods (mediation, arbitration). More information is available on the UOKiK website.
VII. Personal Data Protection

The Seller is the administrator of Clients' personal data.

Personal data is processed in accordance with the Privacy Policy available at: https://www.pleasetouch.studio/polityka-prywatności and applicable law.

The Client has the right to access, correct and request deletion of their personal data.
VIII. Client Rights and Obligations

The Client must use the Store in accordance with the law and refrain from posting unlawful content.

Actions that may disrupt the functioning of the Store are prohibited.
IX. Final Provisions

These Terms and Conditions are available on the Store's website and may be downloaded as a PDF file.

In matters not regulated herein, the provisions of Polish law apply, including the Civil Code and the Consumer Rights Act.

Any disputes arising from the Sales Agreement will be resolved by the competent court in accordance with applicable law.
