Please Touch Online Store Terms and Conditions

I. General Provisions

  • The online store please touch, operating at www.pleasetouch.studio, is run by:

  • These Terms and Conditions define the rules for using the Store, including conditions for placing orders, delivery of goods, payment, withdrawal from the contract, and complaint procedures.

  • By using the Store, the Customer agrees to comply with these Terms and Conditions and applicable law.

II. Definitions

  • Seller - please touch studio Mateusz Dobrowolski, operating a business as specified in section I.

  • Customer - a natural person, legal entity, or organizational unit using the Store and purchasing goods.

  • Consumer - a Customer who is a natural person purchasing goods not directly related to their business or professional activity.

  • Entrepreneur exercising Consumer rights - a natural person running a sole proprietorship who enters into a contract with the Seller not related to the professional nature of their activity.

  • Goods - products offered in the Store, including furniture and accessories.

  • Sales Agreement - a distance contract concluded between the Seller and the Customer regarding the sale of Goods.

III. Order Placement Rules

  • Purchases in the Store can be made as a guest or by registering an account.

  • The Customer places an order by adding products to the cart and completing the order form.

  • After placing an order, the Customer receives an e-mail confirming receipt of the order for processing.

  • The sales agreement is concluded when the Customer receives confirmation of the order acceptance.

IV. Payment and Delivery

  • The Store offers the following payment methods:

    • Bank transfer

    • Przelewy24

    • Stripe

  • Delivery is available within Poland and the European Union. Shipping costs are provided on the Store's website.

  • Delivery time depends on product availability and the selected delivery method.

  • The Seller is not responsible for delays caused by courier companies.

V. Right of Withdrawal from the Contract

  • Right of withdrawal:
    Consumers and Entrepreneurs exercising Consumer rights may withdraw from the contract without giving any reason within 14 days. To meet the deadline, it is sufficient to send a statement before it expires.

  • Form of withdrawal:
    The withdrawal statement should be sent by e-mail to hello@pleasetouch.studio.

  • Withdrawal period:

    • For the sale of Goods, the 14-day period starts from the day the Goods are delivered to the Customer or a third party indicated by them.

    • For service contracts, the period starts from the day the contract is concluded.

  • Confirmation of receipt:
    Upon receiving the withdrawal statement, the Seller will send the Customer confirmation to the e-mail address provided in the order.

  • Exceptions to the right of withdrawal:
    The Customer has no right of withdrawal in cases specified in Article 38 of the Consumer Rights Act, in particular when:
    a) Services have been fully performed with the Customer’s explicit consent, and they were informed that they would lose the right of withdrawal upon completion.
    b) The price depends on fluctuations in the financial market outside the Seller’s control, occurring before the withdrawal period ends.
    c) The Goods are custom-made or tailored to the Customer’s individual needs.
    d) The Goods are perishable or have a short shelf life.
    e) The Goods are sealed for hygiene or health reasons and cannot be returned after opening.
    f) The Goods are inseparably combined with other items after delivery.
    g) The contract was concluded through a public auction.

  • Refunds:

    • In case of effective withdrawal, the contract is considered void, and what has been exchanged must be returned.

    • The Seller will refund all payments, including standard delivery costs (excluding additional costs for a more expensive delivery method), within 14 days of receiving the withdrawal statement. Refund may be delayed until the Goods are received back or proof of return is provided, whichever occurs first.

    • Refunds are made using the same payment method, unless the Customer agrees to a different method free of charge.

  • Returning Goods:

    • The Customer must return the Goods unchanged, unless changes were necessary to determine their nature, features, and functionality.

    • Goods should be returned promptly, no later than 14 days from withdrawal.

    • The Customer bears the cost of returning the Goods.

    • The Seller may delay refund until receiving the Goods or proof of shipment, whichever occurs first.

  • EU Consumer Rights:
    For Consumers residing in the EU, mandatory consumer protection provisions of the country where the consumer resides shall apply.

VI. Complaints and Warranty

  • Legal basis for complaints:
    Customers have the right to file complaints if the purchased Goods are defective or non-compliant, under the Civil Code and Consumer Rights Act.

  • Who may file a complaint:
    a) A Consumer, and an Entrepreneur exercising Consumer rights, may submit a complaint.
    b) Complaints by other Entrepreneurs are considered under warranty provisions and the sales agreement terms.

  • How to file a complaint:
    Complaints must be submitted electronically to hello@pleasetouch.studio, including:

    • Customer name

    • Order number

    • Detailed description of defect or non-compliance

    • Photos of defective Goods (if possible)

    • Preferred resolution (repair, replacement, refund)

  • Complaint handling period:
    The Seller will process the complaint within 14 business days. If no response is given, the complaint is considered justified.

  • Resolution options:
    Upon acceptance, the Seller will offer:

    • Repair of the Goods

    • Replacement with new Goods (if repair is impossible or defective)

    • Refund (if repair or replacement is impossible or unsatisfactory)

  • Warranty:
    a) Consumers have a 2-year warranty from delivery.
    b) Entrepreneurs exercising Consumer rights also have a 2-year warranty if Goods are covered by Consumer rights.
    c) Warranty covers physical defects existing at purchase or appearing during the warranty period.
    d) Remedies include repair, replacement, or refund.

  • Costs of returning defective Goods:
    a) If the complaint is accepted, the Seller bears return and repair/replacement costs.
    b) If rejected, the Customer bears return costs.

  • Withdrawal does not limit rights:
    Complaints do not limit the Customer’s right to withdraw if Goods are defective or non-compliant (see section V).

  • Additional information:
    If the complaint is rejected, the Customer may pursue claims in court or through alternative dispute resolution (mediation, arbitration). More info: https://uokik.gov.pl/.

  • Customers must use the Store legally and not post unlawful content.

  • Actions disrupting Store operation are prohibited.

IX. Final Provisions

  • These Terms are available on the Store’s website and may be downloaded as a PDF.

  • Matters not covered are governed by Polish law, including the Civil Code and Consumer Rights Act.

  • Disputes arising from the sales agreement are resolved by the competent court under applicable law.
