I. General Provisions
 

1. The online store please touch, available at www.pleasetouch.studio, is operated by:

2. These Terms and Conditions define the rules for using the Store, including placing orders, delivery of goods, payments, withdrawal from the contract, and complaint procedures.

3. By using the Store, the Customer agrees to comply with these Terms and applicable laws.
 

II. Definitions
 

  • Seller - please touch studio Mateusz Dobrowolski, conducting business activity as specified above.

  • Customer - a natural person, legal entity, or organizational unit using the Store and purchasing Goods.

  • Consumer - a Customer who is a natural person making a purchase not directly related to their business or professional activity.

  • Entrepreneur with Consumer Rights - a natural person conducting a sole proprietorship who enters into a contract not directly related to the professional nature of their business.

  • Goods - products offered in the Store, including furniture and accessories.

  • Sales Agreement - a distance contract concluded between the Seller and the Customer for the sale of Goods.
     

III. Placing Orders
 

1. Purchases in the Store can be made as a guest or through account registration.

2. The Customer places an order by adding products to the cart and completing the order form.

3. After placing an order, the Customer receives an email confirming its receipt.

4. The Sales Agreement is concluded upon the Customer receiving confirmation of order acceptance.
 

IV. Payments and Delivery
 

1. The following payment methods are available in the Store:

  • Bank transfer

  • Przelewy24

  • Stripe

2. Delivery is available within Poland and the European Union. Delivery costs are provided on the Store’s website.

3. Delivery time depends on product availability and the selected delivery method.

4. The Seller is not responsible for delays caused by courier companies.
 

V. Right of Withdrawal from the Contract
 

1. Right of withdrawal:
A Customer who is a Consumer or an Entrepreneur with Consumer Rights has the right to withdraw from the contract within 14 days without providing any reason. To meet the deadline, it is sufficient to send a statement before it expires.

2. Form of withdrawal:
The statement of withdrawal should be sent via email to: hello@pleasetouch.studio.

3. Withdrawal period:

  • In the case of Goods, the 14-day period is counted from the day of delivery to the Customer or a third party indicated by them.

  • In the case of services, the period is counted from the date of contract conclusion.

4. Confirmation:
Upon receiving the withdrawal statement, the Seller will confirm receipt via email.

5. Exceptions:
The right of withdrawal does not apply in cases specified in Article 38 of the Polish Consumer Rights Act, in particular when:

a) The service has been fully performed with the Customer’s prior consent.
b) The price depends on financial market fluctuations.
c) The Goods are made to the Customer’s specifications or personalized.
d) The Goods are perishable or have a short shelf life.
e) The Goods are delivered in sealed packaging which cannot be returned once opened for health or hygiene reasons.
f) The Goods, by their nature, become inseparably mixed with other items.
g) Audio/video recordings or software in sealed packaging have been opened.
h) The contract was concluded through a public auction.
i) Digital content not supplied on a tangible medium has begun with the Customer’s consent.

6. Refunds:

In the event of a valid withdrawal, the contract is considered not concluded, and all performances shall be returned.

The Seller will refund all payments, including standard delivery costs (excluding additional costs resulting from a more expensive delivery method), within 14 days from receiving the withdrawal statement. The Seller may withhold the refund until receiving the returned Goods or proof of return.

Refunds are made using the same payment method as used by the Customer, unless agreed otherwise.

7. Return of Goods:

The Customer is obliged to return the Goods in an unchanged condition, unless the change was necessary to establish their nature, characteristics, and functioning.
If the condition of the Goods indicates use, damage, or other changes beyond what is necessary to assess them, this will be taken into account when processing the return.

The Goods should be returned promptly, no later than 14 days from withdrawal.

The Customer bears the direct cost of returning the Goods unless the Seller agrees otherwise.

The Seller may withhold the refund until receiving the Goods or proof of return.


 

VI. Complaints and Warranty
 

1. Legal basis:
The Customer has the right to file a complaint if the Goods are defective or non-compliant with the contract, based on the Polish Civil Code and Consumer Rights Act.

2. Who may file a complaint:
a) Consumers and Entrepreneurs with Consumer Rights.
b) Other entrepreneurs - based on general warranty provisions and agreements.

3. Complaint submission:
Complaints should be submitted via email to: hello@pleasetouch.studio, including:

  • name and surname

  • order number

  • description of the defect

  • photos (if possible)

  • preferred resolution

4. Processing time:
The Seller will process complaints within 14 business days. Lack of response means acceptance.

5. Resolution methods:

  • repair

  • replacement

  • refund

6. Warranty (rękojmia):
Consumers and Entrepreneurs with Consumer Rights have a 2-year warranty period.

The warranty covers defects existing at delivery or revealed later.

7. Costs:

  • If accepted - Seller covers return and repair/replacement costs.

  • If rejected - Customer covers return costs.

8. Withdrawal does not limit complaint rights.

9. Additional information:
If the complaint is rejected, the Customer may pursue claims in court or via alternative dispute resolution (ADR), including mediation or arbitration. Details are available at https://uokik.gov.pl/.
 

VII. Personal Data Protection
 

1. The Seller is the data controller.

2. Personal data is processed in accordance with the Privacy Policy available at:

3. The Customer has the right to access, correct, and request deletion of their data.
 

VIII. Customer Rights and Obligations
 

1. The Customer must use the Store in accordance with the law and refrain from unlawful content.

2. Actions that may disrupt the Store’s operation are prohibited.
 

IX. Final Provisions
 

1. The Terms are available on the Store’s website and can be downloaded as a PDF.

2. In matters not regulated herein, Polish law applies.

3. Any disputes shall be resolved by the competent court in accordance with applicable regulations.
